Material change: retention periods not set by law are described as the time necessary for the purpose; data held by external providers and in backups follows their settings; failed payment attempts are kept with the other payment records. Statutory periods are unchanged. New: who sees group chat messages and photos, what happens to them when a member leaves or deletes their account, message reports and group chat rules; the account deletion periods in the Terms match the Privacy Policy. Also: the period for request contacts (3 years), export validity (7 days), retention at the analytics provider (7 years), reviews, web link measuring, the device time zone, e-mails to trainers during the trial and consent to news, offers and tips also by e-mail. Added: photos in the chat with the trainer, the client profile photo and the deletion of analytics data when an account is deleted. Both Terms and Privacy must be accepted again.

Material change. The Terms state that the trainer sells the service as a trader. They distinguish statutory withdrawal from cancelling a booking under the contract: for a session on a precisely agreed date, the statutory exception from the right of withdrawal applies. A consumer may withdraw from a package purchase within 14 days by notifying the trainer; the trainer refunds the payments within 14 days, and a proportionate part of the price is paid for sessions the consumer booked during the period and that took place. The Terms add a model form for withdrawal from a package purchase. Both the Terms and the Privacy Policy must be accepted again.

Clarification without changing any rights. The Terms state that online payments can be turned on by a trainer doing business in a euro-area country or in Czechia, and that the trainer bears Stripe’s fee when a payment is refunded. A consumer may also use the courts and alternative dispute resolution of their EU country. The Privacy Policy adds that a complaint may also be lodged with the supervisory authority where one lives or works. The Terms also say that payments are made from the card the client marks, not that the card is charged.

Material change. The Terms describe card payments through Trely more precisely. If a trainer leaves Trely, card payments through Trely are refunded, as is the amount for unused sessions from a package paid by card; payments made outside Trely are settled directly with the trainer. A payment that is not made never cancels a session on its own; the trainer decides. A waived card payment that has already gone through is refunded in full. A new cancellation window when a session is moved can only be allowed for payment by saved card. The notice before a scheduled payment arrives in the app about 24 hours ahead. The texts also use consistent terms (cancellation window, the payment is processed). Both the Terms and the Privacy Policy must be accepted again.

Material change. The Terms now say that publishing client photos requires the client’s separate, voluntary and demonstrable consent for the specific use, and that a refusal or withdrawal must not be reflected in the terms of your working relationship. The Privacy Policy also corrects an inaccuracy: a trainer’s profile photo is publicly accessible and may remain reachable through a known address or a cache after the profile is hidden. Progress photos and in-app materials remain private. Both the Terms and the Privacy Policy must be accepted again.
